Actually it could be done if the US Supreme Court ruled it unconstitutional. That actually was the case for a minute in the 1970s:

I’m not sure if it could be done legislatively at the federal level; maybe one of our resident lawbros can weigh in on that.

Countries have a habit of thinking progressive legislation is impossible and then 5 years later acting as if it was inevitable.
I’ve hired a therapist who won’t treat transgender folks. She cites her religion as well as ‘countertransference’ and ‘lacking expertise’. But she’s got advanced training and if a transgender individual showed up with the diagnosis she treats best that has shit-all to do with their being transgender this therapist would refuse to treat. It’s 100% bigotry. She’s trying to dress it up as something else, but it’s bigotry, pure and simple.
Which puts me in a hard spot. Obviously I’ll need to try harder to flush this out in future interviews, but that won’t solve the current conundrum. I can’t fire her without severe risk of blowback as she’s otherwise an excellent employee and clinician so I’d have no possible explanation for just-cause, and worse I’d be open to claims I’d have violated her civil rights by firing her for this, and she’d be RIGHT. What a country.
Just needed to seek some validation here. Will definitely try to covertly flush this out in future interviews but need to do so, well, covertly. Ideas?
Just make her life miserable and never give her a salary increase and hopefully she will eventually move on. But obviously never mention anything about her religious beliefs or her bigotry. Play the same dirty game they do.
She was a much better candidate though…
I fail to see how an openly bigoted therapist could be considered “excellent,” given the concerns I would have about her judgement in working with any patient.
If you feel too anxious about the potential consequences of firing her, then you really need to speak with either the agency’s attorney or someone from state board that oversees her profession.
It is a new hire? Not sure if rules are the same down there but in Canada you can let someone go for any reason in first three months. You don’t even have to cite a reason.
What the hell, just fire her.
