The analysis is simple in the NY case. If things go like they should there is very little room for Trump to argue the facts of the subpoena and there will be no basis for another appeal. This is the sort of thing normal litigants cannot and do not appeal, because they lose 99%, piss off the judge, and costs a lot of money in legal fees.
I expect the NY case to move forward without much delay, but a new grand jury may need to be empaneled, covid, etc. (and the judge could just sit on a BS factual motion by Trump for six months, or he could decide it in a week). And, even if the grand jury moves forward everything is secret until itâs relevant to some criminal trial.
I think Trump being nicked by a 1000 cuts is the best weâre going to do right now. I donât buy into the âweakenedâ narrative, but Iâm definitely onboard with a continuous trolling strategy and these decisions may enable some sweeeeet trolling fodder to go at him with. The fact that Trump is already Twitter flailing is a net positive, IMHO.

Trumpâs taxes were never ever getting released before the election no matter the outcome. Even if they ruled 9-0, Trump wasnât gonna say âMy bad. Here you go,â and then give them to Anderson Cooper and Rachel Maddow. And even if he did do all that, it still wouldnât have changed a single voterâs mind.

The lawyers are happy today because the Court reaffirmed that the president is theoretically subject to law. The president cannot invent new legal immunities for himself. Future presidents are on notice. But future presidents are not the immediate problem!

The conservative courts are going to slow roll stuff against Republicans and hustle issues straight to the top so fast peopleâs heads will spin for Democrats.
