The way the CNN lawbro described it was that the exception to a Governor’s request was to “Protect Constitutional Rights”. That’s the exception that allowed Ike to deploy troops to Alabama. The lawbro added that that exemption doesn’t apply here and that the Insurrection Act cannot be unilaterally invoked.

The practical mechanism is whether Governors are willing to use their forces to repel the Army. Or someone in the Pentagon talking sense into Trump.

The military top lawyer under Obama basically said with as few words as possible that it’s all up to Trumps pick, and then down to his counterparts to make it happen under law and went into a longer process wrt how it to manage and delpoy the orders on the Rachel Maddow show tonight.
