The Presidency of Donald J. Trump, Episode XIV: T-minus 97 Hours

The networks should not air him today (or ever again). He is a lock to further incite the mob.

Two nice tweets back to back in my feed.

This seems like the correct response to any Republican call for unity:

Profile of a rioter:

Indeed, in the days since the upheaval, Fellows said his profile on the dating app Bumble is “blowing up” after he posted pictures of himself at the Capitol.

Fellows, who lives in a converted school bus, said he stopped working last spring because of fears of Covid-19. But he said he became disillusioned when New York state denied him unemployment benefits. “For awhile, in early March and April, I was super poor,” he said.

Fellows said he gets much of his news from conservative commentators on YouTube, including Ben Shapiro and Steven Crowder. He said he has also started watching Newsmax and One America News, which have both promoted false claims of a rigged election.

At the Capitol, he said, even though many of the rioters were people he wouldn’t normally get along with, it “felt like family.”

“We were there for one common cause, which is making a statement that the government is crushing down on us,” he said.

Fellows said he came to D.C. in part because he believes that the election was rigged. But his primary motivation was his anger at government measures to prevent Covid-19, such as lockdowns of restaurants and gyms.

When they yell “We the people”, they really mean “Me and my type”.

Apparently he ranted to the press as he left for Texas and nobody aired it.

Nice attention to detail in the captions. Kinda hard to laugh at this one, though.

Yeah, I think the idea of a self-pardon is ludicrous, but how can you be confident that a SC justice will read this:

The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.

and say, “oh, this obviously prevents a self-pardon”? You have to invent a non-textual reason for why a self-pardon is unconstitutional - why would you expect the current SC to do that?

I think people sometimes point to this:

Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.

With the logic being, well they said that if you’re impeached then you can still face prosecution, so it must mean that a president can’t pardon himself? Which seems tenuous, because surely the president could pardon another impeached federal officer. If Nixon had been impeached and convicted, Ford could have pardoned Nixon.

I agree with the crab. Not only is it unclear that this Court would find a self pardon invalid, but the sequencing you guys are posing seems wrong too. Pretty sure the courts wouldn’t rule on the validity of a self-pardon in a vacuum; it would have to be in the context of an active prosecution. Come at me, other lawbros.

I think that was pvn’s original point: that Trump self-pardoning himself would guarantee Trump’s prosecution. Because people would overwhelmingly object to the self-pardon and demand it be tested, which could only happen because of a prosecution.

Can you imagine if, in an effort to get around self-pardon, Trump resigns for a Pence pardon, and Pence doesn’t pardon him. THE ART OF THE DEAL!

Yeah there would have to be federal charges filed for the courts to get involved.
-Trump pardons himself
-DoJ convenes grand jury
-Grand jury indicts Trump
-Trump appeals saying he can’t be indicted for crimes he has been pardoned for
-slowly winds its way to Supreme Court

Tuesdays have been good news lately. Let’s hope tomorrow doesn’t follow suit.
