Iā€™m sure Watson is an absolute scumbag, but I canā€™t help being a little squeamish about the general idea of an employer penalizing an employee for allegations that didnā€™t result in a criminal conviction. It seems like an obviously just outcome for Watson, but it seems less good when you think in terms of random blue collar worker who gets fired for being arrested, even though charges were eventually dropped.

After putting my non-lawyer researching hat on for 5 minutes, it seems like some states offer protection against this kind of thing - California seems to prohibit taking employment actions strictly based on arrest records.

The more general rule suggests that itā€™s ok to fire someone for conduct in the absence of a conviction as long the employer makes a determination that the conduct occurred. So it seems like the NFL would have to conduct its own investigation and conclude that there was inappropriate conduct? And if so, itā€™s fair for them to suspend/punish the employee based on those findings? I guess thatā€™s about as good and fair an outcome as there is.

Ray Rice also had charges dropped. People get fired all the time for making racist statements online. The NFL absolutely should investigate the Watson claims and take action if there is strong evidence. They would be incredibly hypocritical if they didnā€™t.

Using arrest records is incredibly problematic as you can get arrested for nothing in this country and lets be honest would just be another form of racial discrimination so the California law is a good one.

I basically agree with all of this. In the case of people making racist statements online, I donā€™t have any issue because thereā€™s no actual question of whether the conduct happened - the comments are observable. Iā€™m thinking of cases where the arrest was flimsy and thereā€™s no observable evidence about whether the conduct actually happened, and no conviction to rely on.

But if the NFL actually conducts an investigation and concludes that the conduct did happen, Iā€™m ok with it. Meh, I think this turned out to be a very lukewarm take.
