Another thing that that article ignores is that the APA and administrative rules aren’t self-enforcing. If the CDC or FDA bent the rules, or ignored procedure in this instance, someone would have to file a lawsuit to stop them from proceeding, and it would be very difficult for any random person to even have standing to file a suit (unless the relevant statutes provided a way, I have no idea). So, it just reenforces how absurd it is that THIS administration allowed esoteric regulations get in the way of this effort. Even an administration that wanted to follow the procedure could almost certainly find some paper-thin legal justification to give them cover. I don’t consider myself a spectacular attorney by any means, but I’m relatively certain that I could sit down and come up with some coherent, defensible strategy to give.the people cover to the shit done that they needed to do.
