I had no idea JJ McCullough had managed to fail so far upward.
It turns out that Farrow is not even claiming that’s what happened, that was a misrepresentation by Ben Smith. I learned this in the course of reading Ashley Feinberg own Smith.

For the foregoing reasons, the Court finds that the contested statement is an
opinion that cannot serve as the basis for a defamation claim. Plaintiff has not shown
a probability of succeeding on its defamation claims, thus, the Court GRANTS
Defendants’ Special Motion to Strike. Finally, because the Court grants the Motion,

recover [its] attorney’s fees and costs”). The motion is to be referred to Magistrate
Judge Goddard.Because there is no set of facts that could support a claim for defamation based
on Maddow’s statement, the complaint is dismissed with prejudice. After
Defendants’ motion for attorney’s fees is resolved, the Court will instruct the Clerk
to close this case.
These idiots sued Maddow in California. That was a dumb idea for many reasons, the main one being that CA has a strong attorneys’ fees provision for meritless SLAPP suits, so now OANN gets to pay like $400k in attorneys’ fees. Even Devin Nunes and his shitty lawyer are smart enough to avoid filing their nuisance defamation suits in CA.
