They aren’t making interracial marriage illegal. The GOP has campaigned against abortion and they finally got scotus to do it. They’ve wanted this forever.
Seems like “we want to ban interracial marriage, but we’re not racists” is a tough argument to make, even for them.
They’re not going to go after Loving, but they are going to go after other stuff and not care whether it undercuts the reasoning underlying Loving.
I could see them ruling that Bell Curve stuff satisfies strict scrutiny, for example. I could see them upholding landlords refusing to rent if they have a religious objection to interracial relationships. But Loving doesn’t rely on the right to privacy the way Roe, Lawrence, and Griswold do.
I’m much more worried about what the court will do to curtail federal power under the Commerce Clause.
Do you think they’re just going to stop there?
Current Australian government is campaigning at the next election on a bill that would ban trans participation in all women’s sports. And Australia I would consider significantly more progressive (all relative of course) on trans issues so I can only imagine the US are further along than this.
I mean at the scotus level
Depends on who “they” are. The national GOP adopting anti-interracial marriage as part of their platform, probably not. But just think about the number of absolute nutjobs in state legislatures in Alabama, Mississippi, etc.
It’s easily possible they do alot more heinous shit but not interracial marriage.
There is zero strategic value.
No, there’s plenty more, but it’s all shit that’s been “promised” like abortion, the wall, kicking out immigrants, nutty religion stuff in schools and such. Interracial marriage isn’t there ino.
They’ll probably settle for the right to discriminate against interracial couples.
It’s not about strategy.
They’ve appointed so many unqualified, insane judges. The wife of a Scotus justice is a full Qanon nutter
There are unquestionably a number of Trump appointed judges who would ban all of this
There isn’t anything stopping any anti-trans legislation that would need any sort of scotus action
Loving is way down their list. First up is gay marriage, then gay sex, then the right for any government agency to set regulations, then banning science in schools, then massive tax cuts on the rich then maybe they get loving.
Controlling who gets and where the money goes is before gay sex. Changes in criminal law and law enforcement is also before it. I am not saying the GOP wont go “that” far, I’ saying its the other way they want to go.
I wouldn’t be surprised if the GOP fractures more over taxes, child credits, min wage, etc now that 1/3 of their coalition got what they wanted. Not saying that will happen, but the consequences here will likely not be the obvious slippery slope ones. There will be weirdness.
They’re not going to go directly after Loving and outlaw interracial marriage, but that doesn’t mean court won’t get opportunity to reverse it. I could see some state or city passing a religious freedom law that allows clerks to opt out of giving certificates for interracial marriages, which would give court opportunity to overrule Loving.
I don’t think you guys understand how truly insane GOP state legislators and newly appointed federal judges are.
There’s potential for an unforced error if they go too far. States rights isn’t a fundamental position for them. It’s just something they say when it benefits them.
Didn’t people say the same thing about Roe
“Roe v.Wade is settled law”
