This Dobbs outcome is also obscuring other stuff, like the fact that SCOTUS is basically going HAM on religious freedom (for Christians ldo).

With the new conservative lineup, obviously churches can defy public health orders during a pandemic. And now SCOTUS is clearly going to rule that a coach’s right to pray on a football field, with his players, after a game trumps those players’ rights to be free of religious coercion.

Ultimately, they’re very possibly going to go after Employment Division v. Smith, which is the idea that you can’t use religion as an excuse to defy ignore broadly-applicable, neutrally-applied laws.

Here’s a fun summary:

Justice Antonin Scalia, writing for the majority, observed that the Court has never held that an individual’s religious beliefs excuse him from compliance with an otherwise valid law prohibiting conduct that government is free to regulate. Allowing exceptions to every state law or regulation affecting religion “would open the prospect of constitutionally required exemptions from civic obligations of almost every conceivable kind.” Scalia cited as examples compulsory military service, payment of taxes, vaccination requirements, and child-neglect laws.

Yes, imagine the idea that people might try to claim a religious exemption from getting vaccinated!

Man, I don’t see how the upcoming national ban on abortion is going to allow for any exceptions at all. The right is too far gone, and they won’t want to allow for any mechanism that allows for California to be more lax in granting rape or life of the mother exceptions than Alabama would be. Makes me wonder if MrsWookie would be able to get a medically necessary, post-miscarriage D&C in this upcoming hellscape, if a doctor would risk performing that at the risk of facing murder charges.

Except red states are looking to prosecute even if you get an abortion out of state. But I suspect that won’t be enforced unless you’re not white. And of course it doesn’t cover the people who can’t afford to jet off to the West Coast.

I like that, outside the Beltway, absolutely no one on either side cares about the leaker.
