I agree with her, itâs just that their judicial philosophy that influences their determination of what the law and the Constitution requires seems to highly correlate with Republican desired policy results.

Iâve always seen states rights as something conservatives at the federal level fall back on when they want to legislate something they know is clearly bad, but donât want the clap back. Thus, they just say itâs something that should be up to the states.

The most tilting part of the coming gay marriage rollback is that the moderate conservative position will be, âThis actually isnât about gay marriage. We support gay marriage. This is about a wrongly decided case, and stopping judicial overreach. Itâs on Congress to pass a law protecting gay marriage.â
Then theyâll 100% line up to vote for candidates who oppose gay marriage because of whatever dumb culture war issue Fox News is talking about in year 202x.

Itâs always about âstatesâ rightsâ. When they taught us about the civil war they were always harping on that, not about the fact that it was about 1 particular state right that they really, really wanted. This is just the logical continuation of those arguments.
Itâs effectively dead right now.
They donât want to officially overturn it because of single issue voters, just keep letting the base see progress and get closer and closer to it without actually getting it. Base stays motivated to support Republicans as a result. Republicans just want to be able to grab more power and have Dems have less, thatâs what theyâre building toward.
