Not sure where this belongs, but the most recent Strict Scrutiny podcast had a fascinating discussion of a SCOTUS case involving ICWA - the Indian Child Welfare Act.
The short story is that ICWA is meant to provide guardrails that keep native children with their tribe, rather than being removed via foster or adoption by non-tribal families. In this case, a non-tribal Texas family is suing because they wanted to adopt a native child, but ICWA is standing in the way.
The interesting part is that some heavy hitters have lined up behind that family, including the Gibson Dunn law firm, the Texas Attorney General, and Paul Clement. (Summarized here.) The fascinating thing to me was how broad the consequences of this ruling could be.
The plaintiffs are arguing that ICWA should be overturned because it effectively mandates disparate racial treatment. (The obvious retort is that ICWA is predicated on the idea that tribal membership is a political, not racial, identity.) So if ICWA gets overturned based on it being de facto racial discrimination, that sets the stage for dismantling all existing tribal rights. This includes gaming - about one half of all gaming revenue goes through tribal casinos. (Which is one possible explanation for heavy hitters doing pro bono work in an adoption case.) And if the plaintiffsâ broad argumentâall laws and contracts that privilege Native American tribes violate the Equal Protection Clauseâstands, itâs not hard to imagine that they lose all privileged gaming status, as well as other sovereign rights.
