There is a case for specific domestic terrorism laws. I think we’ll see some type of legislative reaction as we see more domestic terrorism.

There seemed to be plenty of forced entry prior to cops letting the rest in. And plenty of video available of violent assaults on cops and others.
He was only charged with misdemeanors so that makes sense.
While some of you are screaming for heads on pikes and the iron fist of justice, I’d like to quietly remind you that the effectiveness of harsh punishment as a deterrent is super dubious, and that the theory also assumes rational actors.
I’m just pissed off that when a couple of windows get broken in a peaceful protest hundreds get kettled up, tear gassed, cuffed for hours and hours, and threatened with 20 years in prison.
And you want there to be a ton more to threaten them with?
I mean, Jesus Christ, there’s not even the federal equivalent of a burglary to be made out here? He fucking broke into the speaker’s office and stole shit. Just holy fucking shit at the undercharging here.
Everybody should be pissed about that. But it doesn’t mean “let’s see how THEY like having boots on their necks for a change!” is an appropriate or effective response to Wednesday.
If the cops hadn’t opened the doors, I would too. But every lawyer is gonna point that out. The guy that stole that letter from Pelosi should absolutely be in prison the rest of his life. But how do arrest some rube carrying a giant flag when the cops are like “Come this way! Go through that door!”?
No, I’m not calling for new laws - no way. I just want these fuckers to have the current book thrown at them.
For surburbanite white people who assumed there were no consequences (and look to be right) there might be deterrent value.
I agree with you in general but this entire class of people believes they are above the law because they mostly have been.
Yeah, part of the penal theory is not just deterrence, it’s also fucking retribution. Fuck these people.
Not sure about this, but IIRC there’s some conflicting case law on whether the death of a co-conspirator qualifies. I think the general rule is it does, though.
Seems appropriate to me.
The cop died too.
So let’s compromise and only press super hard on the ones where we have video of them violently assaulting people and making forced entry.
I’m open to going easy on the people who came along after the doors were wide open and took a stroll through for shits and giggles.
There are laws against terrorism. IANAL but I’m sure they should cover anything that happened on Wednesday.
I mean here’s the fucking DC code:
Burglary in the second degree is a crime with fewer elements and a broader scope. Only two elements are necessary to commit burglary in the second degree:
A person charged with burglary in the second degree faces a felony conviction and two to 15 years in prison .
Just how in the fuckity fuck is he not charged with a felony.
It looks like Ashli with an i may be the only terrorist not to be under charged for this attack. Sad.
