Honestly this is such a rarely used form of original jurisdiction that the Supreme Court has that this is going to actually require a little bit of research to understand. This is part of why so many lawbros hot takes are contradictory right now. I’m having trouble wrapping my head around what Alito and Thomas were actually saying here.

I do think Alito and Thomas are just saying, because the Supreme Court has original jurisdictoin (meaning no other court does), they can’t stop the filing from happening. They just then get to the merits and dismiss. I’m… not sure they’re actually totally off base here?

Not a lawyer but I was curious about their having standing.
Obviously they are arguing that the actions of other states effect them. However the states have contro over the elections. Imagine how insane it would be if every state was suing other states during elections.
My guess is standing failed because the laws of those states are for their citizens.
This is how you know he is dumb. He doesn’t understand how the Supreme Court works or they he was handing them cloaks of invincibility.
Yeah this is what I was getting at earlier from Popehat in the podcast. He expected at least Thomas to dissent. It didn’t mean they were going to actually be for the merits of the suit.

This blew my mind when it happened. I knew it was a huge favorite via lol polling but when it lost I was still legit shocked. This state is done. All the downstate fucks are apparently gonna be billionaires. Wish I was as hard working as them.
