Here’s the deal as I understand it. Each state has a law on the books that determines how it awards its slate of electors for President. In basically every state, it’s awarded via popular vote within a state. However, there are a few that award via Congressional district as well. There’s also a movement for states to enter into a compact to award electors based on the national popular vote.
I set all that up to say that there are state laws – meaning passed by local legislatures and signed by governors. There is an untested legal theory that because the Constitution simply says “state legislatures” determine how electors are awarded, that state legislatures can unilaterally change these rules at a whim. Meaning PA’s red legislature can say, we award our electors to whichever candidate comes last in the alphabet or something.
I’m not saying you’re wrong, I’m saying the whole idea that a faithless elector is even possible irritates me, so I’m going to bury my head in the sand about it being a real problem until it either looks like it might matter or there’s an opportunity to do something about it.
The obvious reform is to have the campaigns pick the electors… and then pick rich people who you can get to sign super abusive contracts to not be faithless and sue them into a hole in the ground if they break it. This is one of the only times you’ll ever see me propose sending in only rich people, it’s because I want this choice to have a lot of collateral at stake for every single person who has the option to be a faithless elector. This is only if we can’t just pass a federal law that eliminates the actual elector position and just assigns the votes officially without the stupid ritual part.
It didn’t prevent Trump so it already failed its one job. Time to go.
Got it - that’s what Levin is talking about. So probably just have to fade a few faithless electors or legislature going rogue then going to SCOTUS and god help us all.

They’re praying for Biden to pull it out so they don’t have egg on their face, but the reality is if the margin is anywhere less than Biden +1.5, they look pretty stupid.
Not sure how CNN’s PA analysis went from “500K ballots outstanding” to “370K ballots outstanding” in the last couple hours when only about 15K votes have been posted.

The nominee of each political party for the office of President of the United States shall, within thirty days after his nomination by the National convention of such party, nominate as many persons to be the candidates of his party for the office of presidential elector as the State is then entitled to. If for any reason the nominee of any political party for President of the United States fails or is unable to make the said nominations within the time herein provided, then the nominee for such party for the office of Vice-President of the United States shall, as soon as may be possible after the expiration of thirty days, make the nominations. The names of such nominees, with their residences and postoffice addresses, shall be certified immediately to the Secretary of the Commonwealth by the nominee for the office of President or Vice-President, as the case may be, making the nominations. Yeah the only way AP and Fox don’t look bad is if they somehow had insider knowledge that the E-day dropoffs in Maricopa would be at least neutral for Biden (as opposed to Maricopa E-day in person which crushed for Trump).

They interviewed PA SOS, who said 500k outstanding. Then someone from her office reached out to CNN to let them know that 500k was an old number and 370k was the current number of ballots.
