Here is the part I have the most trouble with:

I just finished (quickly) reading the ToS for TopShot. The only thing you own is the NFT, but I’m still not really wrapping my head around what that means legally. You certainly do not own any NBA content nor any art “wrappers” from DLI, but there’s also a lot of language about all of the allowed use being non-commercial.

So for example, if I own T206 cards or Picassos, I think I can open a for-profit museum to display them. It’s not clear that I can do that with TopShot NFTs; in fact, my plain reading of it is that I probably can’t. There are more common edge cases though. Say I’m a sports collectibles shop owner and want to set up window / in-store displays of TopShot rares to drive foot traffic to my store. I think that’s the clearest “no” from the terms. What if I want to show my rare NBA highlights on a monetized YouTube channel? Can I get de-monetized for showing video that is copyrighted by the NBA?

Like, of all the things I could see happening, monolithic conglomerate owners of intellectual property transferring that ownership to lol_customers is definitely not one of them.

No they cannot, according to them.

I presume so, which just sets up a ton of dumb cases about digital “ownership” that giant corporations are always going to win in USA#1. They also state that the rights they grant in the TopShot ToS can be reduced by third-party (read NBA) rights holders.

I’ve mentioned this a couple of times but I fully agree with this and which is why I have no intention of making any long term investment in it. I’m probably too much of a coward to actually invest enough to make a quick profit anyway, but investing long term seems ridiculously high variance.

Even if digital collectables remain a thing, the odds of this specific company being the leader is slim.

Is all of the information for the highlight/art contained in the NFT itself? In other words, is it some kind of media (gif/mpeg) file wrapped in blockchain token code?

Okay there have to be some people with better ideas than that. I skipped over the first 10 minutes of this dude hyping NFT potential to get to the part where he lays out some of the specific things this technology will allow us to do.

I’m not convinced that the tech is ponziware just yet, but I am convinced the early visionaries are quite limited in scope and imagination. Middle-aged neckbeards fantasizing about “cool as shit” avatars you can take anywhere. Apparently Nike “already has patents on some of this shit,” which means my kitteh can wear Jordan Diors across the entire internet. Mother of God, we’ve solved almost everything.

The fact that it’s 9:16 portrait mode is really tilting me.

IMO this is dumb but I’m not a collector. A lot of the confusion here comes from the idea that value is somehow inherent in objects. It’s not. If you drop the idea $10k for a video clip makes as much sense as $10k for a photograph or painting.

Value is a social construct.

lol i put my Obi Toppin card yesterday on the marketplace for $57 (the lowest price was $40). look now it’s already sold and the lowest price for the Obi is $100.

bought one pack for $14. sold two cards for $200 and apparently lost out on at least 100 bucks more.

You got two cards from a $14 pack that you immediately turned for over $150. You’re a genius. Is it possible to lose money on a pack? These seem like an incredible investment if you are lucky/quick enough to get them.
