I’m not either, and should have prefaced everything with “IANAL,” but the “knowingly” part has always been the crux of every legal show episode about libel/slander I’ve ever seen.
IAANAL, but from everything I can find, malice is only required for public figures in the US. Normal slander cases only require the plaintiff to prove negligence. Don’t know if the Postle case elevates him to enough of a public figure to have to meet that bar.
