Circuit Court Judge Sandra Lynch vacated Abdelaziz and Wilson’s mail and wire fraud convictions on Wednesday, stating “the district court erred in instructing the jury that admissions slots constitute property.”
So another case of bad jury instructions?
Can any lawbro explain to me what the state can do here? Can they run it again with proper jury instructions, or does double jeopardy apply in that case.
It’s all very confusing to me. Sometimes defendants get legit fucked and there is apparently no recourse. And then there is shit like this.
Those admissions slots are clearly very valuable; someone getting off because they were incorrectly deemed “property” seems like classic LOL LAW
Looking quickly at decision, the judge vacated most of the convictions and remanded back to trial court. So government could retry with proper jury instructions.
It does look a bit more complicated as there were other issues that the appellate court found, so on retrial they may not be able to present some of the same evidence and/or arguments.

Cliffs: prosecutor gets conviction against guy for murder. Gets elected judge. Guy appeals murder conviction, judge independently works to get appeals judge disqualified because he doesn’t like the appeals judge’s approach and thinks a successful appeal could hurt him.
