Legal: estate shenanigans, need advice

Nothing had been filed. The photocopied will showed up just before the process to make Brother the executor (adding to the sketchiness).

Yes to documentation, probably text messages.

General update: we spoke to Brother tonight. He is, imo, in denial about Sister’s actions and intentions but seemed to realize that immediate NC + lawyer up is the right call. He is also extremely saddened by this and we could hear how hard he was taking that realization.

He sent an urgent email to the attorneys requesting a meeting ASAP. An open question I have is whether they actually represent the estate or would/could represent Brother + Wife, or how that all works. I’ll be joining that call and asking that question, along with the other questions you all brought up. Many thanks.

If they show any favoritism to sister then You have your answer. Although I think you know the answer already.

Really you should not show up without representation and the only topic would be to freeze everything until the “will” is certified or not.

Lots going on here and state law matters.

The titling of assets is crucial. You probably can’t do anything about the bank accounts if the sister was named beneficiary or her name was on the account. As for the house, go on the county website and find out how it was titled. If in her name only, it has to go through probate. That requires someone to be appointed executor, file an inventory, etc. That takes many months and often years. Finally, life insurance - named beneficiary will get the money, period.

If the will is found valid (photocopy isn’t likely to cut it), that will control. If not, intestate rules will apply. Unfortunately you have to lawyer up here.

Not an estate lawyer, not legal advice!
