Pannick says it is more difficult to apply a Padfield principle to a prerogative power than to a statutory power.
But it is still possible, he says.
And he says there is an important principle at stake - whether the exercise of such a power frustrates the purposes for which such a power applies.
Victory for government could enable a future PM to prorogue for a year, court told
Pannick says, if this issue is not justiciable, people have to ask what might happen if another PM were to prorogue parliament for six months or for a year.
And he says it is no good referring to Dicey for guidance on this because he was writing in another era. And Dicey said something like that would be most unconstitutional.
Pannick says this is a legal question. And legal questions are for the courts to determine.
He says the only remedy he is seeking is a declaration that the PM’s advice was unlawful.
He says the government, in its submission, says the PM will comply with the declaration of the court.
Pannick concludes by apologising for over-running his time by a few minutes, eating into the time available for lunch.
And now the court adjourns until 2pm.
Going back to this for a moment. Hostile architecture is one of the most egregious examples of the cruelty of capitalism, and there really ought to be more noise about this. I took my daughter to an open day at York University last weekend and we were both disgusted to see spikes around the walls of the buildings, specifically designed to discourage the homeless from settling comfortably on the floor. Needless to say we didn’t feel the need to stay long.
A hidden tragedy of brexit is that suddenly nobody is talking about social policy, all anyone cares about is whether or not we remain in the EU. This shit is setting us back years.
We get a passengers coming out of the station asking the police to move the homeless folks on as all around the station is where the heat vents are located in most buildings.
I usually try to point them in the direction of Shelter charity for their complaints as I tell them it’s not a loitering issue but a social issue and why it bothers them so much when all they ever do is walk past them for what? 4 seconds a day.
I was just listening to LBC radio and Brexit is affecting all of Europe’s domestic policy’s in the same way as its dominating everything atm.
Our drug related deaths are way up the last 2 years and the football violence has also started to be real nasty again, fortunately this is 1 of my MP’s main issues and he has done extremely well when faced with adversity against it.
We must do something about the homeless problem!
Oh you mean give them food, build more low cost and communal accommodation so there are beds available for them and provide easy free access to rehab programs and educational opportunities?
No I just mean move them to where I don’t have to look at them for 3 seconds a day.
During the morning of today’s supreme court hearing, the live stream on the court’s website was accessed 4.4m times - with 2.8m stream requests being logged in the hour before the 1pm break for lunch, the Press Association reports. Typically, the live streaming service is accessed about 20,000 times a month.
I’m on edge today, I feel like this ruling could make our democracy or ruin it for good because some people be saying that if prorogation is allowed to be used this way what’s to stop them shutting parliament for a year or so.

This is what worries me the most about today’s hearings

Wait didn’t Scotland’s Supreme Court already settle the matter?
I can’t get hyped for UK politics unless Black Rod is involved.
Scottish Court went one way - High Court the other - Supreme Court to decide.
As StrontiumDog says The UK supreme Court has the final say.
UK Supreme Court trumps High Court and Scottish Court.
Turns out “the people” (who’s will we should unquestionably implement) don’t seem to be huge fans of tory policies.
Man I hope Johnson visits some place near me. I’m gonna go off son.
