Does the USDA have the authority to do this if the states have banned the practice? If it could, why would the case have gone to the Supreme Court?

Knowing nothing about the issue I think it’s highly unlikely the federal government could force states to permit this. Doesn’t mean Alabama doesn’t allow it. An interesting issue would be if CA could criminalize the importation of such meat and the companies behind it. Want to go to Disneyland? Well there’s a warrant out for you.

I used to work with a guy who refused to eat pork because he once saw a video of someone fucking a pig.

I’ve only dug into this for a few minutes via google, but based on what I’ve seen so far, the current state of the law is:

A) There is definitely no federal law explicitly banning the crates, but also nothing explicitly authorizing them

B) Because there is no clear federal rules, states have some leeway to make their own standards. Most of the states with bans just say, "if you’re raising pigs in this state, you can’t use the crates. ", but California also says that pigs/pork products raised this way can’t be sold in the state.

C) California got sued in federal court by out of state producers who wanted to sell in California and argued the law unreasonably interfered with interstate commerce. That case is what made it to SCOTUS

So, my read is that the feds still might have the ability to preempt the states if 1) Congress passes something like a national law explicity authorizing the cages or 2) the USDA can reinterpret some existing law that it can use to claim preemption. The 2nd path seems a little bit tricky to me b/c of recent rulings that restricted the power of administrative agencies, but who knows what one federal judge in Iowa might do when they get the chance to help a local farmer stick it to some So Cal bacon bro?

California can kind of de facto somewhat control/influence a lot of stuff this way. Like emissions from cars and the trucking industry. If you can’t do it there or sell it there, that’s more than enough of the economy to influence how a nationwide business does any of their production. Why build a set of trucks that meets California emissions and another set that doesn’t, etc

Yep. California and Texas are kind of the yin and yang for this kind of legal disputes b/c they are so big. Like you said, cars are a big thing with California.

The Times ran a story a few years ago about how big textbook publishers often make a ā€œnationalā€ version of a book, but then make edits to satisfy Texas and California (and smaller blue states usually buy the Cali-fied version and smaller red states often take the Texas one).
