I appreciate the post. I think the problem is that we figured out that a combination of democracy + poor education + absolutist free speech + internet/social media is a toxic combo.

Thatā€™s not how trademark law works, but I guess they paid their $250 filing fee and get some yucks.

What else do they have to do?

Be the first to sell goods or services that use the applied for mark as an indicator of the source of goods or services and not for its informational content. They also have to provide actual specimens of use (well, jpgs or pdfs), and a slogan on a t-shirt is not a valid specimen.

They could apply for ā€œWhite Lives Matterā€ as a trademark for, say, pool cleaning services (under the recent ā€œSlantsā€ rock band case where the Supreme Court loosened restrictions on profane or offensive marks), but they would need to be actually selling pool cleaning services (or paint, or toothpaste) under the White Lives Matter brand.

If they then sent a cease and desist letter to my client who sells White Lives Matter hand cream, I would tell them to get lost because there is no likelihood of consumer confusion regarding the source of goods because they are distinct in character.

Itā€™s interesting, because sheā€™s playing a recognizable game with rules, itā€™s just a game totally divorced from any concern with truth or ethics, but I think to understand trumpist politicians and voters we need to empathize with their understanding of politics as a game that you try to win for personal advantage. For voters politics is primarily a means of identity expression, where the identity is that minorities and egg heads and queers are trying to take my stuff. (And my stuff, or my feeling of entitlement to stuff I donā€™t actually have but should have, is allotted to me by virtue of a just universe that recognizes my natural entitlement.) The bummer for them is that other than president the thing that you win isnā€™t that great unless you have significant concerns about public policy. I guess a lot of people kiss your ass and you think youā€™re a big shot, but just ask Rudi, or Chris Christie, or John Boehner how much that is worth, whether psychically or monetarily, in the long run.
