I would suspect that litigation involving individuals is much more likely to be contentious as it’s going to be more personal for the parties. I also think solo practitioners or small firms layers are more likely to be like that as it’s a way to make a name for yourself. Biglaw lawyers/firms are also more likely to be repeat players so don’t want to get themselves or their firm a bad reputation - which can hurt you with judges.
I’ve mostly dealt with corporate clients so you don’t have the same level of animosity amongst the parties. Only twice have I dealt with lawyers who were super aggressive about everything. Once it was definitely just the lawyer as I’d been warned about him in advance. The other time I’m pretty sure it was the client, as the client had been a dick in his deposition.
Looks like this is going to be a NO BET then. I think if the court does order specific performance, the normal, formal acquisition process could last well beyond mid-2023.
That being said, I’m still marking this as a mental bet and I look forward to big I TOLD YOU SO energy when the court rules against Musk.
