Not a lawyer, but I don’t think it’s going to cost that much to get this tossed out of court. For one thing, Trump won Iowa and the election, so he wasn’t damaged, and good luck proving that he was. Plus, polls are what they are. They’re never totally accurate, and don’t claim to be.
The “rape” case is totally different, in that, in many states, rape is defined by “penetration” whereas sexual assault doesn’t necessarily have that implication.

Agree that he’s mainly trying to embarrass or harass media outlets, but I think most will take a harder line that ABC did. The media outlets have lawyers already on retainers for things like this. The ABC case was different because I think Trump really had a decent chance of winning.
If Trump has proven anything in his life, it is that he’s relentless. Even if it gets thrown out (and I agree that it probably will unless he actually has some evidence of bad faith/manipulation by the paper or Selzer), he’s appealing it all the way through the courts while also reminding Ganett that he oversees the agencies that can allow or block newspaper consolidation.
I’m not saying they definitely won’t fight it, but even a simple case isn’t going to be a quick victory against Trump (and probably Musk and Thiel in the background)
