It’s not Merchan that is failing. It’s the system.
The part of the system that’s broken here is that there’s no option for the judge to have full discretion in the amount of the fine. Everybody knew there was zero chance Trump was ever gonna get put behind bars for contempt, but at least let the court have the leeway to say they’re doubling the fine every time, and Trump will start to feel some pain (or finally learn to STFU) after the first ten offenses or so.
It’s no different than needing to issue traffic tickets on a sliding scale. The stupidly rich dude caught doing 110 in his Lambo could not give two fucks about paying a $500 ticket so he’s gonna keep doing it; make it $40k and maybe he’ll stop to think about it.
Some European counties do traffic tickets like that with a sliding scale.

But it’s the other way around. The system has giver Merchan a way to stop Trump from interfering with the trial, Merchan just won’t do it. Every single check against authoritarianism has always reduced down to some judge or senator who just doesn’t quite feel like holding Trump accountable today.
Like, there are clear rules for impeaching a Supreme court justice, there’s all kinds of precedent and high-minded legal writings from the Founding Fathers about getting rid of corrupt public servants, no one actual in office feels like using those tools.
Yes. It’s not a ton different than Garland delaying because he doesn’t want to actually deal with Trump; apparently anyone who can doesn’t want to. Remember during his impeachment trial in the Senate, various Senators specifically saying that the proper way to pursue action against Trump was in the courts when he was no longer POTUS. Even Trump’s lawyers argued this on the floor of the Senate. Now here we are, in the courts with Private Citizen Trump, but apparently there’s some magical, liminal state of citizenship between POTUS and regular citizen (at least that’s what it sounds like Merchan is saying) where we still can’t apply meaningful, effective consequences to this fucking guy.
It’s kind of a tough position for the judge to be in. If he jails Trump ~40% of the public is going to treat it as unjust, but as it stands, all these chances he’s giving Trump is causing a good 40% of to also lose the little faith in the rule we have left.

I would feel very happy if he were jailed for even a single day. A single hour. Anything that takes us beyond the precedent and puts him behind bars for any amount of time.
Obv I will still complain, but him being jailed for any amount of time would mean a lot in my eyes.
