On the one jury where I was in the box for voir dire, here was how the final jury selection went:
Juror 1, you are selected. Juror 2, you are selected. Juror 3, you are selected. Juror 4, you are selected. Juror 5, you are excused. Juror 6, you are selected. Juror 7, you are selected. I was juror 5. They had the last laugh because I got Covid #1, despite wearing a mask throughout. This was just past the peak of Omicron (early March 2022) and I was not allowed to skip jury duty, despite saying in my attempt at a written excuse that I was concerned about Covid (response was: we have all the best Covid precautions, denied).
When I went to the courthouse that day, I was in an extreme minority wearing a mask. Jury selection was a lot different than had been done in my previous times, where they shuttled off 75 of us to a low ceiling muggy courtroom across the street and prior to that we had to sit in a low ceiling muggy holding room for about an hour sitting across from each other on each row (it was in the low 50s outside). Maybe 25 or 30 people were wearing masks. I was pretty mad a few days later, since I’d had all the vaccines and was wearing a mask diligently…
Too much handwringing over the jury, IMO. You can’t just nuke everyone you think might be bad, that’s not how it works. Call me naive, but I don’t think someone who says he reads the NYT and watches some Fox News is sitting in that jury deliberation room being an obstinate obstructionist. Manhattan was 87/13 Biden in 2020. Some of that 87% are going to have some habits that don’t seem like a slam dunk guilty vote.

No, because the defense is looking for a glimmer of hope. They’re seeing the Fox News and Daily Mail like we are and hoping it’s code. They’re willing to take that shot. For all we know, he could say he watches Morning Joe and Nicolle Wallace on MSNBC, and only reads the conservative opinions in the NYT, which would give his entire game away. I’d guess at least 9 times out of 10 this is a Trump leaning voter. Who actually tries to read the Daily Mail? That makes no sense.
I was on a jury in this same building a couple months ago and the first juror seated was indeed named the foreperson. I think whether or not they take on a leadership role in the jury room depends on the jury.
I was the foreman for my jury and you don’t have any assigned responsibilities in the jury room. The only thing you’re assigned to do is communicate to the judge. Inside the jury room it’s all up to whatever rules you come up with as a jury.
In my jury one of the jurors took iniative to lead the discussion and we all let her.
