Now keep going. The losing side goes to the state supreme court and lose again. They donât like the decision and appeal. In the appeal, they put in some bullshit about how the valid state law is really unconstitutional. SC takes it and upholds the bullshit.
I mean if they wanna argue that itâs unconstitutional to seek restitution of money gained thru fraud, good luck with that. Zero chance SCOTUS overturns on those grounds. To my knowledge there are no punitive damages here. The entire amount is what was calculated to have been gained thru fraud plus interest. In the Carrol case they can argue an unconstitutionally excessive fine. Not so in this one

I assume you donât follow SCOTUS.
In the past few years they have ruled on cases with known fake claimants, with no legal standing, using wholly made up legal theories with no precedent, to overturn centuries old laws with rock solid precedent. One of the justices happily rules on cases where his wife could be a litigant and another takes massive bribes in the open.
The âlawâ as you are describing it means literally nothing to them.
They are going to overturn the abortion pill on the theory of standing that someone might take it, suffer harm, and a pro-life doctor might have to treat them thus hurting the doctor âaestheticallyâ. That is the word the superior court actually used to rule in favour of ban.
This is why I find it so hilarious there are people on this forum who still think trump is facing consequences.
