Any opinion that supports immunity to any genuine degree in this case will be crazy from the get go.

Like, there may be some room for carve-outs from prosecution, and “official acts” (while too broad) is the standard exception. (However, there is no “official acts” exception even when ORDERED to do X in the military. Maybe hold the president to the same standard as the troops; after all, his actions are not compelled.) But, while flawed, “official acts” is a nice, lazy conservative rule that has left presidents unmolested for 235 years.

The one thing that a rule must absolutely capture is the worst case, and the worst case is impeding the lawful transfer of power. That’s literally the thing in history that destroys every functioning society. I haven’t seen that emphasized enough–the one job the court has is to absolutely preserve the ability to prosecute those who would seek to retain power unlawfully.
