This strikes me as the step that gets law bro’d. I think a straight mandate would be upheld, this gonna fall into the government telling business what to do BAD category with current court IMO

My company is right around the cutoff point and deplorable leaning, can’t wait to hear the talk about this. Maybe they’ll just fire a few people to get under the threshold.
He’s also requiring healthcare workers to get vaccinated through some Medicare/Medicaid authority.

Yeah, I can see a lot of smaller companies resisting this. But I think compliance culture at big publicly traded companies is such that they will just go along with it.

Most large companies want their people vaccinated anyway. Fortune 500 companies are run by ruthless calculating sociopaths that like to present narratives about employee “wellness” that paint them as Good Leaders. Those people are not raging deplorable culture war Republicans. But many smaller companies are run by culture war Republicans.

Because it’s a coordination problem. It makes it smooth and easy for everyone if it’s a mandate. And they are not going to lose 25% of their workforce.
That article is from early February and predates the detection of Delta in the UK and US. Delta didn’t even get the name “Delta” until the end of May. You would get near complete agreement that it’s going endemic now.
That’s not at all obvious.
