I think they think it is more objective to describe what they can see (āhis eyes were closedā, āhis attorney passed a note to him, but he did not look at itā, etc). In contrast, saying he was sleeping seems more like a conclusion that is very likely true, but cannot be known with 100% certainty. Itās kinda like how many reporters would not call Trump a āliarā because they thought that required insight into his state of mind, but they would say things like āx statement is falseā or āclaimed, without evidenceā.

The judge should pull each one of his politician toadies in tomorrow, put them under oath and ask detailed questions about coordination of these attacks to get around the gag order under penalty of perjury. At least he could make them sit there for like 10 hours.
