I think thatâs where readbacks come in. Part of the wizardry of some lawyering in Texas is to distract people so much from the evidence in the case that they forget what was important due to notes not being allowed.

No idea. Only thing I could think of is if youâre taking notes, maybe youâre not paying attention to the presentation of other evidence while youâre writing.

Right - the secondary concern is that jurors are idiots and may take incorrect notes, but then in deliberation will use them as actual evidence, and other idiot jurors believe the notes instead of the actual evidence.
Not allowing access to the transcript is just dumb. I think at one point the concern was that the transcript could be wrong, but with modern stenography that isnât really an issue any more.
