All three guilty of felony murder, only the shooter is guilty on malice murder. Seems like a just verdict.

Its weird that a defendant can be convicted of more than one murder count when there is only one murder victim. But different states have different laws for this I guess. In Florida, I don’t think you can be convicted of more than one murder count per victim.

They were each charged with three counts of felony murder because there were three different underlying felonies. I don’t think it will matter for sentencing if you’re convicted on one count of felony murder or all three.

It made the reading of the verdict brutal for the third guy. Malice murder, not guilty. First count of felony murder, not guilty. Second count of felony murder, guilty. Oof.

Yeah I noticed that too. Just as he was getting his hopes up. Still kind of strange law though. Like I said, I’m only really familiar with Florida law, and I don’t think that’s a thing down here. One victim = one murder count.

Also the cameraman helped box in Arbery with his truck, which I didn’t realize until today. So he’s on the hook for the false imprisonment and then the felony murder on that. Sucks to be you.

Also it seems weird that aggravated assault can be an underlying felony for felony murder. Wouldn’t that make any killing felony murder regardless of intent?

I forgot that the video of this one was released by one of the accused who thought this would make them look better.

Right. The reason this case got press is the cops and prosecutor initially ruled this was justified.

I’m saying that’s dumb. Georgia has a voluntary manslaughter law:

(a) A person commits the offense of voluntary manslaughter when he causes the death of another human being under circumstances which would otherwise be murder and if he acts solely as the result of a sudden, violent, and irresistible passion resulting from serious provocation sufficient to excite such passion in a reasonable person; however, if there should have been an interval between the provocation and the killing sufficient for the voice of reason and humanity to be heard, of which the jury in all cases shall be the judge, the killing shall be attributed to deliberate revenge and be punished as murder.

But if the killing also included an aggravated assault they can just charge felony murder? Why even have a manslaughter law then?

Probably not a great idea to record yourself doing murder crimes.

The crazy thing is they didn’t even need the video to prove the case against the McMichaels, this prosecutor could have gotten a conviction without it. Once the judge ruled that the the defense’s reading of the citizen’s arrest statute was mistaken they were totally fucked. And I think they were fucked even before then as they needed probable cause to arrest Arbery and and in their own words they just wanted to talk to him. Which, sure, they have every right to talk to Arbery but Arbery has every right to say fuck off and keep walking. So it wasn’t a valid citizen’s arrest, it was just a series of crimes starting with false imprisonment and culminating in aggravated assault and murder.

Which should have been obvious to the authorities video or no, agree that it’s nuts that they weren’t charged. Good ole boys club with the dad being an ex cop probably.
