The Supreme Court, in its order Thursday, said, “The application to vacate the stay entered by the United States Court of Appeals for the Eleventh Circuit on September 21, 2022, presented to Justice [Clarence] Thomas and by him referred to the Court is denied.” There were no dissents by any of the Supreme Court’s justices noted in the order.

The thing about SCOTUS is that all of them have an ideological belief and a vested interest in defending the judiciary as an institution. Yes, the conservatives have an interest in promoting conservative government, but not at the cost of dismantling judicial authority. I expect them to throw the Independent State Legislature stuff in the trash for the same reason.

They can do whatever they want without “dismantling judicial authority” and they know it because the other side is determined to never recognize their illegitimacy.

But here the proposition was to undermine the authority of the Eleventh Circuit, with the ISL it’s to say that state Supreme Courts don’t have jurisdiction over the legislature on important questions. My point is that I don’t think that IS “what they want” on a fundamental level. Part of their political project is to preserve the broad institutional power of the judiciary.

I’ll agree with you on that not being what they want if it were applied evenly, but you forget that they can just do a Bush v Gore type of case whenever they want to get around any rules they’ve made up previously if it suits them. They also know that a majority of state legislatures are going to be permanently R, or at least R for the rest of their lives so they can just use their power to knock down anything they really don’t like from the other blue states like they already do.

Maybe. I definitely don’t think it’s out of the question that Moore v Harper could reverse the SCNC ruling, although I expect that to go down 5-4 with Roberts and ACB joining the liberals. If they do reverse Moore v Harper I think it will be quite limited in scope though. I’m willing to make bets on all the above if you’re interested.

It would be peak Democrat to reintroduce this requirement with the current court’s makeup.

He isn’t this dumb. The only possible explanation is he is on it. He wants what they want.

That’s’ the same argument that the pro-cheaters use in the HCL scandal, that Robbi can’t possibly be that dumb to think J4o is a good call, so she must be cheating. It’s the same argument that is used in forum wars, that [insert poster here] can’t possibly be that dumb, so they must be trolling.

While the conclusion validly follows from the premises, the entire argument is fallacious because it sets up a false dilemma between two possibilities.

Those are really bad analogies that don’t at all apply.

Even if the conclusion ends up being true, the path to getting there is poor thinking.
