Saw an interesting question posed on Twitter

Is it possible for native Americans to set up abortion clinics on tribal lands that are not subject to state law?

Would they?

No, it is not possible for the same reason that a tribe could not make murder legal on tribal land.

Iā€™m sure this is a dumb question, but what reason is that?

Not trolling. Iā€™m not a lawbro, but I am interested in the mechanics of how all this works.

That would be quite the pickle for Gorsuch, wouldnā€™t it.

lol, you donā€™t think the DeSantis admin will find a way to shut down abortion clinics on tribal lands? Theyā€™ve been engineering this for decades, theyā€™re not going to be stopped by a loophole.

Thanks, looked into this and clearly it is more complicated than my prior understanding of tribal law.

So new polling from right before and right after the leaked ruling shows a net enthusiasm gain of 2% and a net generic ballot gain of 6%!!!

Dems go from losing the generic ballot poll by 1% toā€¦

Losing by 7%. Republicans are the ones who gain 6%. New generic ballot 49-42 from 45-44.

All I know about tribal law is that itā€™s not straightforward.

While often prosecuted under state laws, murder is also a federal crime. The constitution overrides state and tribal laws, but SCOTUS relegated abortion decisions to the states, correct? If so, why canā€™t they set up abortion clinics on tribal land?

Because fuck you thatā€™s why

Heā€™s referring to the legal reasoning frequently employed by conservative justices. Proponents argue itā€™s a well-established jurisprudence while its critics say itā€™s a form of judicial activism.

The answer to this question will ultimately be decided by the Supreme Court of anyone tries anything.
