I think Hugo Black was in such bad shape that he may have been pushed out or the decision kind of made for him, although it was described as a retirement. You need his family to be in on it. Roberts seems like an institutionalist who would not cooperate with trying to cover for Thomas.

Short answer: yes, impeachment is probably the only true solution.

There have been some examples where the other justices tried to work around the potentially compromised justice by holding off certain votes. And if a justice is completely absent, there are plenty of examples where the court has operated with less than 9 justices. The worst case scenario imo is if Thomas can be physically present, but his mental capacity is compromised to such an extent that his clerks are basically just pulling a glorified Weekend at Bernie’s routine.

Thomas dying and the dems somehow replacing him and yet roe still overturned this summer and they’re never able to re-overturn it would be the absolutely peak dem party moment.

No it would only truly be peak Dem if Manchin made them take a moderate, and despite Roberts voting with us we lost 5-4 because they fucked up and appointed a pro life judge.

Watching Cory Booker and he’s got a kind of energy that’s refreshing to watch in a hearing.
