In theory, judges have plenary authority over sentencing. The federal guidelines were passed by Congress as mandatory, but that was ruled an unconstitutional imposition on the courts. Courts still follow the guidelines 99% of the time, but the judge could sentence Stone to life. Sentences are generally not appealable, but we live in interesting times.
I think she’ll give Stone 5-6 years, which is under the guidelines but will make the pardon look worse.
