Yeah I know it seems annoying and blah blah blah but this is exactly what they want. They want you to not care enough about the courts.
Roe v Wade, gay rights, etc. are sexy (can’t believe I’m phrasing it this way), but this other shit is a direct attack on our system that is wholly unsupported.
I’m really not sure which views you think I hold, so whatever. In any DC Circuit case you’re drawing live to 2-3 nutsos. In the Supreme Court you’re drawing live to 5 nutsos, which is one reason I support SCt reform.
And yes, the en banc Flynn decision came back with 7-2, with the 2 being the original panel majority.
I’m not Preet (not that Preet’s that bad) and I never contemplated being any sort of prosecutor because I’ve always had concerns about the prosecution of many cases. For similar reasons, I never considered acting as a defense attorney–most defendants are guilty and plenty are terrible people. (That said, I did help a friend who is a public defender seeking to get the death penalty overturned for a brain damaged defendant who has been exposed to massive amounts of pesticides his whole life.)
As far as law generally, I’m willing to toss the whole system out as soon as a better one arrives. I look forward to your suggestions for potential improvements to the rules of civil and criminal procedure to make the justice system more just and efficient. (I was a big fan of 2015 amendments to Rule 26.) Or perhaps we can have a new system for the appointment of judges–maybe a bipartisan commission, maybe random drawing of lots or whatever.
Note that I’m on board with a wholesale rewriting of the constitution. Perhaps you could offer some favored proposals to help move the discussion along. Otherwise, when you complain about “the law” or democracy it looks to me like your just complaining about humanity. That’s a fine complaint to have, going back to at least Plato, but we unfortunately have to build a government and legal system with the populace we have, not the one we might want.
Also, if there were a lot fewer guns the cops would not have an excuse to train and act like a paramilitary operation. See, e.g., Germany, UK, Japan, Australia, etc.
