I think I’d have to write a custom rake script or the command will run on the entire DB, which could take hours and would probably screw something else up. The alternative would be to copy the posts into yet another thread while being careful to move them in chronological post order.

@cuse, I can see your point about not assigning 100% or 0% judgment in a case that calls for a split, but I think you’re giving too much weight to the possibility of the rape being accidental. If a man “accidentally” rapes a woman, esp in a way that leaves her neck bruised and vagina hacked up, then I find it hard to believe he cared about consent. And frankly your hypothetical of “Don’t! Stop” vs “Don’t stop!” is weak as shit. It would take a lot more than that for a normal person to accidentally rape someone. I’m gonna say it’s borderline impossible, without brainstorming it.
Also, even if she did have other partners around the time, it’s not like they were the ones she accused of rape. I’ll go with the simple explanation that her rape injuries came from the man she actually accused of rape, the one saying bullshit like, “I can’t tell how hard I squeezed, my hands are strong lol”. Like we’re to believe he can’t feel if a peach is ripe without squashing it and crushing the seed.
I skimmed most of the discussion, but one point Cuse made which seemed to go unchallenged (at least directly) was the notion that choking can be a component of a consensual sexual act.

I agree with those who argue that the mere presence of the criminal complaint creates a presumption of guilt (that Kobe would have an uphill battle rebutting), and that the other medical evidence of violence makes that presumption virtually ironclad.
I can’t imagine what would motivate someone to defend Kobe on these facts other than rank hero worship.
My male students in China were all Lakers fans because they adored Kobe. He was an A-list celebrity there and Kobe embraced that role.

Great point. The most generous scenario for Kobe is that she gave “signs of consent” only after feeling like she had no choice in the matter. Or perhaps she was initially into it until, out of nowhere, he took it from foreplay to roughing her up, at which point she felt paralyzed. Both of those would still make him a rapist. The partner with lopsided power (in this case physical) has the responsibility not to intimidate the other into fake consent. It’s not hard to see how choking the shit out of a stranger without warning could give them the impression that saying “no” isn’t allowed or would have no effect.
While I disagree with Cuse’s take, I wouldn’t go as far as others saying it’s a bad look for him, esp given his body of work. I feel like he simply overthunk this one. We analytical types can be analytical to a fault.

Also one other thing I’m not sure was mentioned but you don’t just choke your first time sex partner, even if that’s something you normally do. You have to specifically ask consent for that even if you did have consent for sex which he didn’t.

Anything to do with airway restriction is expert level sex that should only been done between partners who have a long history of trust and demonstrated ability to read each other. Even then it’s probably top of the list of sex acts that should really be avoided at all times.
Given the facts of this assault it is far more likely Kobe committed many unreported assaults.
