With Trump he would probably really want anything that he thought he might be able to sell later or lord over someone with. The only stuff he’d let go is the stuff he doesn’t understand the value of (probably a lot of it).

Can someone explain why they would do this besides the standard “they’re in on it”?

This one I’m not quite sure what the entire context is. They’re arguing that Wray should be deposed before Trump, because maybe that would result in Trump not having to be deposed at all. It seems like they never want Trump bothered. When DoJ was defending Trump against E. Jean Carroll they were claiming he made his slanderous comments in his duties as POTUS, so he was untouchable, or something. Oh hey! Wow, that 2024 election is coming up! Probably should shelve everything now just to be prudent and respect norms.

It’s to protect the office of the presidency from unnecessary testimony that could be intended to waste time. Imagine if every Republican lawsuit against the government could be used to haul Biden in for a deposition. The apex doctrine holds that you should interview lower official first and work your way up, even if the higher-up officials are former officials. And you have to demonstrate that the higher figure has personal knowledge that can’t be acquired elsewhere.

It’s not saying that Trump can’t be deposed at all, just that there are strict conditions that he or any current or former government official can be deposed about their activities in office to prevent people from using lawsuits to harass officials. If his deposition is necessary, it will be compelled, but they do have to prove it is necessary and they have to depose Wray first to show that it is necessary.

I don’t think we are that much worse off, especially considering Gorsuch doesn’t carry the veneer of being a liberal Justice, like Garland would.

Also Garland would have insta resigned during the Trump admin anyway as soon as they accused him of some bullshit like accepting a $5 off give certificate from Starbucks. To protect the integrity of SC.

garland never had the liberal label. he was an extremely centrist jurist which obama thought would help his chances replacing a staunch conservative. butnahh, mcconnell pretended garland was unconscionably left and kept the seat vacant
