Those who came before Judge Paul Bonin of the Orleans Parish Criminal District Court specifically found themselves steered toward ETOH Monitoring LLC, with Bonin consistently tying release from GPS monitoring to paying all fees to the company.
Yet Bonin failed to disclose that he received thousands of dollars in campaign contributions as well as a loan from ETOH, and that he was previously the law partner of one of the company’s principals.
That suit against ETOH—in this case, the private company was operating as a state actor—was recently struck down not because the partnership between the two was deemed appropriate, but because ETOH did not have a similar arrangement with other judges.
“Plaintiffs’ allegations depend on the specific relationship between former Judge Bonin and ETOH and therefore fail to state an institutional incentives claim,” reads the Court’s decision. In other words, the company is protected from liability because the relationship only existed with Bonin, and not across the entire judiciary.

Someone I love is currently very mentally ill. Over a decade of regular hospitalizations, consistently diagnosed as bipolar. Current manic episode is very bad.
This person is off their meds and has previously executed a durable POA giving their spouse the ability to commit them against their will.
Spouse called the police and EMS, who showed up, read the POA, and…did absolutely nothing. The sick person believes they are communicating with and in love with musicians who are speaking to them in code via music, as one example of the severity.
So, uh, what was the point of the POA? Maybe this belongs in the lol police thread, I don’t know.
It’s possible the spouse is going to need a judge’s order in order to have the partner committed. I wouldn’t expect EMS workers to forcibly remove someone from their home based on some paperwork a spouse was exhibiting.
I don’t know much about this, but at least in AZ the mental health care POA gives somebody “the authority to make decisions about mental health treatment only while that person has been determined to be incapacitated which means under Arizona law that a specialist in neurology or a licensed psychiatrist or psychologist has the opinion that the Principal is unable to give informed consent.”
So I guess I’m also not surprised that unless the person is out of control, danger to self or others, etc, they’re not going to take them away in that spot.
Maybe the best option is to get an evaluation at a mental health facility (or maybe even an ER?). It might be possible to make arrangements in advance to be sure the facility has an available bed and knows they’re coming. I realize this may be easier said than done. Good luck to all involved.
This person absolutely refuses to be evaluated. For obvious reasons.
The POA explicitly says “my agent may have me hospitalized against my will” and “even if there is not a current emergency.” Heading to court tomorrow morning.
This person’s doctor gave a massive adderall prescription plus a Vyvanse prescription to someone with bipolar. What the fuck.

Can someone explain to me how this works? How are these requests assigned? Is it just lucky that they got Sotomayor and not Thomas? If Thomas, et al are really rustled by a denial, is there anything they can do?
