I’m beginning to think this is the case, primarily because all I hear the media talking about is 4 votes. Earlier though I swear I heard reports that he would be put in the role of breaking a tie. I think you guys can back me up on that.
Yeah. So technically his options are vote yes, vote no, don’t vote. Two of his options though amount to the same thing. That doesn’t seem right. Meantime, I think the media needs to drill down on Republicans not wanting their man Roberts voting while Democrats largely do.
The biggest effect of this is going to be Mittens, Collins, etc. lying to resistance grifter Kyle Griffin that they’re considering allowing witnesses. Griffin uncritically tweets out their lies. Smacc and kre8ive post griffins tweets here. We jerk each other off about how smart we are.

It seems pretty convenient that the number of supposedly moderate republican senators that might consider voting for witnesses is exactly equal to the number that would be needed.

Surely if quid pro quos are okay, then disparaging a juror must be okay too. Would this be permitted in a real trial? First move today by House prosecutors should be to ask Roberts to hold Dershowitz in contempt.
