Iā€™m still kinda unclear on exactly how the Speaker election works. Nothing, including swearing in reps, can happen until the Speaker is elected, but if itā€™s the incoming house that votes how are their votes legal if theyā€™re not yet sworn in?

Hereā€™s how it goes, apparently. So it looks like they vote for speaker before they are sworn in. It does seem a bit nonsensical. Seems like it would make more sense for the clerk to swear everyone in first, but this is the way it is.

The precedent is that unsworn members can participate in organizational business at the start of a session.

The clerk of the House is empowered to run proceedings according to the House rules until the Speaker of the House is elected.

So, I guess the technical answer is that the incoming House can vote on the Speakership because the Clerk says they can.
