But as I’ve written before, Trump could win by losing this motion. Most pretrial rulings in criminal cases can’t be appealed until after a trial and verdict. But disputes about immunity have been an exception to that general rule, and Trump would have a strong argument for appealing a denial of his motion to dismiss. That could consume months, and the clock is ticking ominously toward Election Day 2024.
