Correct. I technically work for my wife as she started the consulting biz in her field and was easier for me to join than have two companies. We do have a 1099 contractor that is a retired colleague of my wife’s who works part time for himself and didn’t want to register a business. We take a small cut to pay for our cpa.
Even if you get denied a loan there’s a good chance you’ll get the $1k grant. I have never heard a single peep about anything and probably won’t take a loan if offered, but they still dumped a thousand bucks in my bank account.

Quick question for anyone who might know.
My parents have a construction/cleaning business and they had a guy that worked for them as an independent contractor who quit in February because he wanted to work at the post office for a less labor intensive job. This week my parents get a letter saying he is filing an unemployment claim against them (he worked at the post office for a little bit quit because they were giving him long hours). From quick googling I see that the CARES Act lets independent contractors collect unemployment due to covid related reasons but he quit before covid was a thing here and it wasn’t related to covid reasons. I can’t tell if Illinois allowed independent contractors to get unemployment before that but it doesn’t seem like it. Should my parents have any issue disputing this claim? Anyone have experience disputing unemployment claims and how difficult it is?
If he’s an independent contractor he can’t file a claim against your parents. But if he was an independent contractor he can’t quit either. And if he quit he can’t claim unemployment.
I suspect your parents were calling him a contractor to save on taxes and insurance even though he was legally an employee, and that even if this guy’s claim is bullshit, they’re still in the wrong about what the legal relationship was. gl to them getting out of this mess.
Ok got it. So he was doing construction work for another company that my parents work with and they told my parents he needed some extra work so they asked my parents to see if they had any for him and they took him on a few days a week, sometimes less depending on how big the projects were and how busy their regular employees were. And by quit I guess I mean he left both jobs once the project he was working on was done to go work at the post office. I’m not 100% sure what the arrangement was for how much work he would get and how consistent it was but I guess I’ll ask them and just tell them to talk to the unemployment office that sent them the letter. That actually sounds like maybe he could be classified as an independent contractor. Either way, I can’t see them being liable for the unemployment claim. If he gets CARES money, that’s a federal program that has nothing to do with your parents or any state UI they pay. If he was an employee, he quit and isn’t eligible.
Lots of things to unpack here. The first is: he can file for unemployment as a contractor now since the cares act passed. Second: claims aren’t really filed against a specific employer, they are just filed, and prior employers are notified of the filing. I’d say he likely had to submit paystubs/names from his contarct work. Thirdly: all your parents need to do is fax in a statement detailing exactly what happened (that he was a contract worker who quit voluntarily to take another job. They should also say that they aren’t protesting benefits in general for the claimant, but they are protesting any benefits that will have any effect on their contribution rate or that will classify the claimant as an employee instead of a contractor. That will protect them, and the guy will still be able to draw depending on his eligibility determination from the post office job. He may well get denied because of the circumstances (voluntarily leaving both jobs).

Spoiler alert, this very likely won’t get resolved anytime soon. If the extra income is needed now, reach out to your state Senator and assembly person that represents your district. It took my Assemblywoman filing a legislative inquiry on my behalf with the DOL for my issue to get resolved.

My wife FINALLY got the unemployment payments she was owed a full month after her first payment. It was kind of fun, actually, to see the big unemployment windfall hit our bank account all at once.
A reprieve. My May 9 entry error has been fixed and it is now listed as my UA amount, not $0.
So I’m going to give it a few days to see if it now pays out. I really don’t want to call.
When my lump sums came in after 9 weeks of error it was $5,400 and $1,900. Certainly was a huge relief, just sucks for people who needed that money in the interim.
