An article on Vox raised an interesting point that I hadn’t considered.
In Trump’s latest screed disavowing the Republicans who will certify the electoral results, he specifically called out Tom Cotton. Cotton used to be one of Trump’s biggest cheerleaders… if HE fails Trump’s loyalty test, surely that will show any other GOP stooge jumping through his hoops that they can be removed from favor for any perceived slight.
What I don’t get is WHY the GOP keeps placating him?!? Just because Trump can sic the base on him? God willing, Trump’s influence will start to fade in about two weeks, and the GOP will have a major schism over an identity crisis in a post-Trump world. Why does everyone think he can keep this kiss the ring, the State is Me circus going?
People just aren’t wired to adjust to malignant narcissists. Like, people that are married to malignant narcissists require tons of hands on therapy to break the behavior patterns.
Third parties (with some exceptions) break attorney-client privilege. This is not as true for confidential information related to lawsuits. It’s been a while since I looked at it, but I know for Attorney-Work-Product the standard is something like whether the disclosure is likely to lead an adverse party getting it.
I would assume similarly, a less absolute waiver standard would apply to settlement negotiations. Typically, if you share information with an adversary in connection with settlement negotiations, that information is confidential. I would think so long as the third parties you involve in these discussions are not likely to break that confidentiality, the act of having them on the call does not waive your confidentiality.
That said, usually you have to make clear that the communication is in connection with settlement negotiations - which doesn’t seem the case here. Plus given that Trump was the first to talk about the call, he’s going to have a hard time arguing that Raffensberg couldn’t then talk about it/share the entire call.
Not sure why this guy has the scoop. Why can’t Trump’s own detail escort him out? Has he surrounded himself with loyalists who believe he is the rightful winner?
There are like 50 million reasons why this is a bullshit argument lol. Let’s go with a few:
Confidential settlement discussions means that it’s shit that can’t be used in the lawsuit being settled.. Not that it’s confidential for any other purpose.
Even if that somehow applied, and it doesn’t for a bunch of other reasons, it wouldn’t cover soliciting someone to commit a fucking crime;
Even if that somehow didn’t apply any confidentiality, which Trump doesn’t have in the first place, but lets pretend he does, gets fucking waived when Trump tweets about the call.
There’s like 47 more reasons why this argument is dumb.
Hmmm. Why would it be the Secret Service’s call on whether he is “removed” or not? If they’re told to remove him, they should remove him. Who are they answering to? I don’t know who this guy is or where he got his info from. Not buying it though at this point.
Wasn’t there a story just last week about some secret service guys needing to be fired because they were Trumpstains or something? I think it’s up thread but FU I’m not scrolling that far.

He’s a Hollywood “insider” whose beat seems to be celebrity gossip. If his info is legit, I would guess there are ex-SS working to protect celebs who might have info from their former colleagues.
