his case got changed last week to a different judge. while this new judge is also a republican appointee he doesn’t appear to be a complete fucking stooge like reed o’connor. so the lawsuit is probably dead.
that obviously wont stop him from harassing and intimidating people over it though.
If the stooge judge had ruled in Musk’s favour, is that appealable?
i would think so. considering the judge was found to own up to 50k in individual Tesla stock he would have some interest in how the case was decided.
it’s very unlikely it gets to a trial regardless though. that’s the whole point. it’s a SLAPP suit and was specifically filed in a jurisdiction that doesn’t have anti-SLAPP laws.(strategic lawsuit against public participation) the real intent isn’t to win the case. it’s just to harass and force the defendants to spend money they likely don’t have. you just beat them into submission. GARM the non-profit advertising safety group that was part of the lawsuit is shutting down.
He did it to media matters and they have had to shut down divisions and lay off a bunch of staff just to pay for the lawsuit. In the media matters one O’connor ruled in Musks favor a bunch of times in the pre-discovery phase making the defendants produce way more than usual at the stage and costing them significant amounts of money to produce while refusing to look at the defendants motion for summary judgement.
