I don’t see Sotomayor voting for that.
I would expect her to uphold the “fighting words” doctrine as an exception to the First Amendment, but not necessarily to agree that whatever incident prompted the court case was an example of fighting words. She would probably end up writing an opinion that was a concurrence in part and a dissent in part if this came before the SCOTUS.

Biden and the eDems, as pro-business/pro-capitalist parties and politicians are wont to do, do not actually want to do the things that would actually prevent fascism, ie. weaken/abolish fascist institutions & build up and support left movements for social and economic justice. They just want to use the specter of fascism to fear monger in order to get people to vote for shitty candidates–the kind who at best will appease fascists and at worst will collaborate with them.

I think he did it on accident but he’s not wrong. It’s like what happened with the narrative around Tamir Rice, or Trayvon Martin’s baby picture getting posted. These people need to infantilize the shooting victims because they do have a long list of people they wouldn’t mind being murdered by the police, and they need to separate the two in their mind.
It’s bad because there’s no crime the kid and his friend could’ve been committing that warranted getting shot and killed, and if the cop couldn’t achieve his goals without killing somebody then the bad guy just gets away that day. Not because there was a sweet little angel cherub baby involved.

There should be no police. Police shouldn’t shoot anyone just because they run. It’s still worse to shoot a child. Angel or not, it’s worse to shoot a child.

All kidding aside the regular cops should be unarmed people with degrees in fields like social work. Then if those people say the situation needs violence we can bring in the SWAT team for all I care.
This is a very optimistic view of the world.
It’s as optimistic as I can get it without it warping too hard. It’s that or wallow in soul sucking depression, which I’ll pass on. Not that it’s a choice, I just try to pick better subjects for my depression like ‘why am I such a piece of shit’.
You might become more depressed when earnest social workers are marched, unarmed, into “mental health” call outs.
